DECISION and ORDER

SIRAGUSA, District Judge.

Eric R. Adams, Esq. (“Adams”) is suing Chicago Insurance Company (“Chicago”) claiming that Chicago has a duty to defend and indemnify him in a lawsuit alleging professional malpractice brought against Adams by Patricia E. Novak (“Novak”). That malpractice suit is separate from this case and is pending under docket number 01-CV-6196 and assigned to the Honorable Jonathan W. Feldman, U.S. Magistrate Judge.
