The accused was convicted by a special court-martial of three offenses for which he was sentenced to a bad-conduct discharge, confinement at hard labor for three months, forfeiture of $25.00 per month for three months, and reduction. During the course of his trial, testimony was received reflecting the commission of other offenses not encompassed by the charges. Specifically, this testimony reflected that Beaty had threatened to kill a sergeant, and that, contrary to published and well-circulated orders, he consumed alcoholic beverages in his quarters.
