McBRIDE, Judge.

Plaintiff, Paul H. McAlister, aged 43, instituted this suit against Liberty Mutual Insurance Company, the workmen’s compensation insurer of Bernard & Byrd, Inc., his former employer, to recover workmen’s compensation benefits for permanent total disability at the maximum rate for injuries sustained in an accident on December 23, 1949, during the course and scope of his employment as master mechanic. McAlis-ter was standing on a timber brace which was hit by a piling, and as a result he, the timber, and the piling all fell a distance of IS to 20 feet into the Florida Avenue…
