This decision resolves a summary judgment motion in this case of alleged police misconduct. Plaintiff Arturo Cruz brings claims under 42 U.S.C. § 1983 and New York law, alleging that the City of New York (the “City”), New York City Police Department (“NYPD”) Officer Eugene Donnelly, and unidentified NYPD officials violated his civil rights under, inter alia, the federal and New York State Constitutions. Cruz’s claims include false arrest, malicious prosecution, excessive force, false imprisonment, negligence, invasion of privacy, and battery.…
