This is an action of tort in which the plaintiff alleges damage to his property, namely an automobile, caused by the negligence of the defendant. The answer is a general denial and allegation of contributory negligence.
There <was evidence that on January 25, 1961 while approaching Gloucester Street on Commonwealth Avenue in Boston the plaintiff brought his car to a stop and while in this stopped position was struck in the rear by a car operated by the defendant.
