OPINION
DAVID S. PORTER, District Judge:
This action is brought by the Board of Education of the City School District of the City of Cincinnati, Ohio, and by Robert L. Braddock, Virginia K. Griffin, Henry C. Kasson, Charles D. Lindberg, Mary T. Schloss, individually and as members of the Board of Education of the City of Cincinnati. Accordingly, these parties are hereinafter referred to collectively as the “plaintiffs” and sometimes simply as “Cincinnati.” The Cincinnati Board of Education will occasionally be referred to only as the “Board” or “CBE,” and these designations should be read as…
