MEMORANDUM AND ORDER

ANITA B. BRODY, District Judge.

Petitioner Richard A. Washington (“Washington”) petitions this court for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. I referred the petition to United States Magistrate Judge Diane M. Welsh for a Report and Recommendation (“R & R”) in accordance with 28 U.S.C. § 636(b)(1)(B). The R & R recommended that I grant the petition in part and deny the petition in part.
