Appeal by the defendant from a judgment of the County Court, Westchester County (LaCava, J.), rendered June 8, 1993, convicting him of criminal possession of a controlled substance in the fifth degree, upon a jury verdict, and imposing sentence. The appeal brings up for review the denial, without a hearing (West, J.), of the defendant’s motion pursuant to CPL 30.30 to dismiss the indictment.

Ordered that the judgment is affirmed.
