OGG, Judge.

Appellant pled guilty to Count I, murder second degree, Count II, attempted armed robbery, and Count III, conspiracy to commit armed robbery. The plea agreement also provided that the sentence imposed for Count III would run concurrently with the sentence imposed for Count I, that the state would not present any evidence in aggravation, that a diagnostic evaluation pursuant to rule 26, Rules of Criminal Procedure, would be conducted prior to sentencing and would be considered by the court in sentencing, and finally that the allegation of a prior burglary conviction would be…
