This action was begun by the defendant in error, in the district court of Pottawatomie county1, to recover damages alleged to have been sustained by reason of the institution and prosecution of a replev-in suit. The petition alleges, in substance, that Harris instituted an action in replevin against Milligan to recover possession of four bales of cotton. This action was begun in the justice of peace court, there decided in Milligan’s favor, appealed to the superior court by Harris, and the appeal dismissed for want of prosecution.
