The action is for false imprisonment. On December 19, 1934, at about three o’clock in the morning, the plaintiff, together with two other men, William Bowe and Stephen Cleesattel, was arrested by two special officers employed by the defendant and charged with the theft of a quantity of potatoes from freight cars standing in the yard of the defendant railroad company at Twelfth avenue and Forty-first street in the city of New York.
