This case comes to this court on error from a judgment of the district court sitting within and for Carbon County, granting a peremptory writ of mandamus requiring the county' canvassing board of said county to assemble and convene and proceed to count and record and enter upon the proper poll sheets as required by law, 13 ballots cast by electors of said county who were absent from their polling precincts on the day of election, viz,: Nov. 3, 1908, which ballots were returned to the clerk of said county and had been opened by said canvassing board, and to include the…
