The complaint in one count charges the respondent with the unlawful possession of intoxicating liquor at West Rutland, on the 21st day of November, 1925. Respond•ent pleaded not guilty. A trial was had by jury in the Rutland city court on January 2, 1926, resulting in a verdict of guilty.
It appears that before and on the day in question the respondent was the owner of record of a certain building situated on the east side of Main Street in West Rutland; that the rear portion of the first floor of the building he used for a pool room, and in front of that room was a room in which he sold…
