MEMORANDUM OF OPINION

EDWIN L. NELSON, District Judge.

This is a petition for the writ of habeas corpus filed by a person in custody1 of the State of Alabama following a criminal eonviction in the courts of that state. 28 U.S.C. § 2254.

I. Introduction.
