MEMORANDUM AND ORDER

LUNGSTRUM, District Judge.

Plaintiff Michael Palmer filed this civil rights action against defendants alleging unlawful arrest and use of excessive force in violation of his Fourth, Fifth, Eighth, and Fourteenth Amendment rights. Additionally, plaintiff asserts common law claims for false arrest and imprisonment, battery, negligence, negligent supervision, and misuse of the criminal process.
