On February 22, 2009, T.B., a minor, hit R.P., in the mouth causing injury. R.P.’s mother sued T.B. and his parents in state court, seeking to recover damages for the resulting injuries. T.B.’s insurance carrier, State Farm Fire & Casualty Company, agreed to defend T.B. in the underlying lawsuit under a reservation of rights, and filed this declaratory judgment action asking the court to declare that it has no duty to defend or indemnify T.B. under the terms of the homeowners’ policy.
