The plaintiff in error, hereinafter called defendant, was, on a charge of murder, in the district court of Marshall county, convicted for manslaughter in the first degree and sentenced to serve a term of 20 years in the state penitentiary.

A brief summary of the facts developed on the trial are that in the year 1922, the deceased, McAdoo, lived on a farm belonging to defendant, Walker. During the year a dispute had arisen between them over the sale of some whisky in which they were both interested, which dispute apparently had been reconciled, after which defendant loaned McAdoo 3^ sacks of…
