Dawson, J.:

This was an action' by parents for the death of their seven-year-old son who was run over by a street car, causing injuries from which he died.

The accident happened while the car was being backed on a Y track. The child climbed upon a drawbar projecting behind the car. The conductor had alighted or was about to alight on the other side of the car to turn the switch and did not see the lad.
