This is a suit in equity instituted in the district court of Kay county, Okla., on the 11th day of April, 1921, by J. B. Turner and 23; other property owners in the city of Blackwell, appellees herein, against defendant, H. C. Ferriman, appellant herein. The plaintiffs allege in their petition that they are the owners of certain real estate in the city of Blackwell, and specifically describe the same and the location thereof, and further allege that the defendant, without the consent and against the will of plaintiffs, is about to erect two 10,000 gallon storage tanks for…
