In this appeal from an order granting respondent-defendant’s motion to set aside a jury verdict of guilty, we are required to determine whether the trial court erred in concluding that the evidence presented by appellant-state at trial was so at variance with the allegations in the indictment as to warrant the granting of the motion. Remaining issues are whether our trial courts have the authority to set aside a jury verdict of guilty and whether the state can appeal from such an order.
