The action is one of most unusual character. It was instituted on May 18, 1927, the complaint alleging substantially the following facts, stated in narrative form: The plaintiff, Skalowski, is the owner of a store building in the city of Spartanburg. On August 20, 1924, he leased it to the Cannon & Fetzer Company for a period of five years, commencing January 1, 1925, at a rental of $425 per month; the lease taking the place, as of January 1, 1925, of a lease between the same parties then in operation.
