This cause comes before the court upon the appeal of Ohio Edison Company from the judgment of the Summit County Court of Common Pleas denying its motion for attorney fees pursuant to R.C. 2323.51.

On December 11, 1988, Donald Kelleybrew was a passenger in a vehicle driven by Edward Johnson, Jr. Johnson was traveling on North Howard Street in Akron at a high rate of speed when he apparently lost control of the vehicle, went off the road, and struck a utility pole.
