MARGOLIS, Judge.

This military back pay case is before the court on plaintiffs motion for summary judgment and defendant’s cross motion for summary judgment. Plaintiff, John D. Snakenberg, was given a general discharge from the United States Marine Corps on September 3, 1985. On May 26, 1987, plaintiff filed this action seeking back pay, an order correcting plaintiff’s record and reinstating him in the Marines, equitable and punitive relief, and attorney’s fees and costs.
