This is an appeal from the denial of appellant Donald Butzen’s motion to intervene in litigation between Robert Shea (“Shea”) and First Capital Advisers, Inc. (“FCA”), 1 among others. We have jurisdic tion pursuant to 28 U.S.C. ■§ 1291 because the denial of a motion to intervene, whether as of right or by permission of the court, is treated in this Circuit as a final appealable order.
