Medora Snyder, plaintiff in the Court of Common Pleas, appeals to this court on questions of law and fact from a dismissal by that court of her amended petition and a judgment against her for costs. The substantial facts disclosed by the evidence are as follows:

In September of 1928 the Ridge Hill Development Company, Inc. (hereinafter referred to as Development), was organized as a corporation for profit under the laws of Ohio, its purposes as expressed in its amended articles of incorporation being for:
