This is an appeal from a verdict and judgment obtained by defendant in error, Otha L. Cubbison, hereinafter referred to as plaintiff, for damages for personal injuries in an action against plaintiff in error, Howard W. Allen, doing 'business as the Allen Bus Lines, hereinafter referred to as defendant. The action grew out of a collision upon a public highway between an automobile in which plaintiff ■was riding and a truck being operated by defendant.
