Presently before the court is defendant’s motion for judgment on the pleadings as to Counts I and II of plaintiffs’ complaint [9-1].

FACTUAL BACKGROUND

This case involves claims under the Clean Air Act, 42 U.S.C. § 7401-7642, and common law claims for trespass, nuisance and negligence per se at Huber’s oriented strand board (“OSB”) plant located in Jackson County outside Commerce, Georgia.
