Cureton, Judge:

The respondent, National Bank of South Carolina (Bank), instituted this action to recover the collateral securing a loan or, alternatively, its fair market value. On motion of the Bank, the circuit court ordered that the case be transferred from the jury to the non-jury roster because it was equitable in nature. W. H. Daniels, Jr., doing business as Daniels Tobacco Warehouse, appeals. We reverse and remand.
