MEMORANDUM AND ORDER

LUNGSTRUM, District Judge.

I. Introduction

This case is a products liability action arising from injuries allegedly suffered by plaintiff as a result of an accident which occurred on November 9, 1988 in Garlstadt, Germany while the plaintiff was enlisted in the United States Army. Plaintiff claims that he was a passenger in an armored ammunition carrier, designed and manufactured by defendant BMY Combat Systems, when a personnel heater, designed and manufactured by defendant Stewart-Warner South Wind Corporation, exploded in flames, causing him injury.
