In 2004, Plaintiff Innis Arden Golf Club (“Innis Arden” or “LAGC”) discovered that its property was contaminated with organic pollutants identified as polychlorinated biphenyls (“PCBs”). Innis Arden hired an environmental-consulting firm, O’Brien & Gere (“OBG”), to investigate and coordinate the elimination of the PCB contamination, and then brought this civil action against the owners and operators of several nearby properties to seek reimbursement for…
