On this day, the Court considered the testimony and evidence presented by Plaintiff ASARCO LLC and Defendants CEMEX, Inc. and CEMEX Construction Materials South, LLC at a trial conducted before the Court from July 26 to August 1, 2013, in the above-captioned cause.
