MEMORANDUM OF DECISION AND ORDER

BENSON, Chief Judge.

In this declaratory judgment action plaintiffs seek to recover, on the basis of a policy of comprehensive general liability insurance issued to plaintiff Rolette County by defendant Western Casualty and Surety Company (Western), the attorney’s fees and expenses incurred in defending a civil action brought against plaintiff LeRoy Ouelette 1 by Richard and Mary Ann Guzman.
