Lary sued Barton, the sheriff of Eastland county, and the sureties upon' his official bond to recover the value of certain peanuts alleged to have been the property of the plaintiff and converted by Barton. The latter impleaded and asked for judgment over against the First State Bank of Carbon, .Tex. The plaintiff recovered judgment, and all defendants appeal.
