This is a wrongful death action brought by the parents of Molly Ferguson Shattuck, a 19-year-old freshman at Boston University, who in the early hours of February 9, 2005 was *289killed when she was struck by an MBTA commuter rail train while walking with a friend on the tracks located in what is referred to as “Beacon Yards,” adjacent to the university campus.
