The plaintiff filed this tort action in the Superior Court against the city of Lynn (city) for the alleged wrongful death of Crystal Valezquez (Crystal) and injuries sustained by Philip Valezquez (Philip).3 The underlying facts are not in dispute. On January 6, 1996, eleven year old Crystal and her twelve year old brother Philip were sledding on snow-covered stairs at High Rock Tower in Lynn.
