The plaintiff in error, hereinafter called defendant, was convicted in the district court of Carter county of the crime of assault with intent to commit rape, and his punishment fixed at imprisonment in the state penitentiary for a period of five years.
The information on which defendant Avas tried charged rape in the first degree, it being alleged that defendant on November 19, 1927, accomplished an act of sexual intercourse with one Marie Mayton, a female under the age of fourteen years who was not then and there the Avife of the defendant.
