The appellants, J. H. Freeman, Jr., and W. O. Freeman, plaintiffs in the court below, sued the appellee, T. L. Truitt, defendant in the court below, to recover the unpaid balance due on a certain promissory note executed by the defendant, T. L. Truitt, to J. H. Freeman, deceased. The declaration was filed on June 9, 1958. The appellants are the sole heirs at law of J. H. Freeman, deceased, whose estate had been fully administered in the Chancery Court of Leflore County prior to the date of the filing of the declaration in this cause.
