This is a suit in equity to set aside, because of newly discovered evidence, the judgment in the case of Ignacio Sartori v. Denny-Renton Clay & Coal Company, which was entered in the superior court of King county on February 6, 1913, and on appeal affirmed by this court on September 31, 1913, and to retry the issues there determined. Our. opinion affirming that judgment, and to which we now refer for a full statement of the issues and evidence on which *547that judgment rests, is reported in Sartori v.
