Appellant Miller entered into a written contract with the Indiana State Highway Commission to furnish materials and construct a certain public highway. To secure the faithful performance of the contract, Miller, as principal and appellant Federal Surety Company as surety, executed a bond for $336,000 payable to the state of Indiana, the condition of the bond being as follows:
