This is an action upon an undertaking given by the defendant. On the 28th of May, 1857, the plaintiff in this action recovered a judgment in a justice’s court against one Charles E. Burgett, for the sum of $85.70, damages and costs, and from that judgment Burgett appealed to the county court. No execution was issued on the justice’s judgment.
