MEMORANDUM AND ORDER GRANTING SUMMARY JUDGMENT

The above referenced action is a case of first impression, grounded in Title II of the Americans with Disabilities Act (“ADA”), 42 U.S.C. §§ 12101 et seq., the Fair Housing [Amendments] Act of 1988 (“FHA”), 1 42 U.S.C. §§ 3601 et seq., and 42 U.S.C. § 1983.
