Appellant, Joseph Anastasi, filed a grievance contesting the refusal of the Montgomery County Police Department (“the Department”) to promote him from sergeant to lieutenant. The Department, through Chief of Police Carol Mehrling, denied Anastasi’s grievance, and he appealed to Montgomery County’s Chief Administrative Officer (“CAO”). After a hearing, the CAO also denied Anastasi’s grievance, and he filed another appeal to the county’s Merit System Protection Board (“Merit Board”).
