This appeal involves the constitutionality of an ordinance of the City of Springfield, Missouri.

Said city appealed from the judgment of the Criminal Court of Greene County, dismissing the complaint.

The complaint, which originated in the Municipal Court of said city, in substance charged that “on or about the 19th day of September A. D. 1926 at the aforesaid City, within the limits of said city, W. W. Smith, then being the owner and manager of a moving-picture show located in said city, and known as the Grand Theatre, did then and there wilfully and unlawfully…
