In 1857, tbe street commissioners of tbe third ward of tbe city of St. Paul, deeming it necessary to construct sidewalks on “ St. Anthony Street ” and “ Dayton Avenue,” notified tbe owners of lots chargeable with tbe expense of making such walks, to construct tbe same. *309The lot owners having failed to construct the walks, the street commissioners entered into a contract with the plaintiffs to construct them.
