Appellant was tried by a general court-martial, officer and enlisted members. Despite his pleas of not guilty, he was found guilty of one specification of a twelve-day unauthorized absence and two specifications of assaulting a child under 16 years of age in violation of Articles 86 and 128, of the Uniform Code of Military Justice (UCMJ), 10 U.S.C. §§ 886 and 928, respectively. The court sentenced Appellant to confinement for 3 years, forfeiture of all pay and allowances, reduction to pay grade E-l, and a dishonorable discharge.
