Julius Spahn was-indicted jointly with James Blake for theurime of burglary, and both defendants being tried on a plea. of not guilty, were convicted, and the punishment of each was fixed by the jury at imprisonment in the penitentiary for the term of eight years. Blake was awarded a new trial, but Spahn’s motion for a new trial was overruled, and sentence was pronounced upon him in accordance with the verdict, and the record is now brought here at his instance by writ of error.

It is urged on his behalf that, in view of all the evidence, there is a reasonable doubt as to his guilt, and that…
