We granted Respondent Georgianne Conant’s request for rehearing in this matter. The opinion filed on December 31, 1986 is withdrawn and the following substituted therefor.

Defendant Abran Rodriguez, d/b/a Abe Rodriguez and Associates (defendant), moved the district court to set aside default judgments entered against him in favor of plaintiff Georgianne Conant (plaintiff) and cross-claimant and co-defendant Catherine Katona (Katona).
