This is an appeal from a judgment of the district court of Carter county in favor of ihe defendant in error and against the plaintiff in error. In this opinion, the parties will be referred to as they appeared in the court below.

This ease originated in the justice court in Carter county and was from there appealed to the district court in said county. The action was brought by plaintiff for the recovery of double the amount of usury theretofore paid by plaintiff to defendant and for a reasonable attorney’s fee and costs.
