sitting in place of MR. JUSTICE GALEN, disqualified, delivered the opinion of tbe court.

This action was instituted for tbe purpose of quieting title in tbe plaintiff to tbe northwest quarter of section 33, township 34 north, range 5 west of tbe M. P. M. Tbe allegations of tbe complaint, in so far as material here, are that tbe plaintiff is tbe owner of tbe lands in question; that Glacier county claims an interest therein by reason of a tax deed issued to it and that such tax deed is invalid because, it is alleged, tbe notice of application for such…
