The above-entitled cause is now being determined as an error proceeding by reason of trustee’s appeal on the question *482of law from the judgment of the Court of Common Pleas of Franklin County, Ohio.

Plaintiff, a foreign corporation with its principal office in Newark, New Jersey, and doing an insurance and loan business in Ohio with its servicing Ohio loan office in Cincinnati, about 1926 made a loan to The Joyce Building Realty Company in the sum of $200,000.00.
